First and foremost, you will have to prove that you are innocent and have the charges dropped or dismissed. If you are found guilty, it is not possible to bring a case against anyone for false arrest. By definition, if you were guilty of the crime then the arrest was valid. They believe that since they are innocent they do not need representation, but that is simply not the case. You are now free to bring suit against the police, if they were the ones that falsely arrested you, right? No, it´s not that easy. There are many forms and documents that have to be filled out in a very specific way, filed with a specific office within a specific time frame. To make matters worse and more complicated, the deadline to have the forms turned in by is different depending on if it is the city or state that arrested you. Most of the time a city will require that the documents be turned in within 6 months and the state will require them within a year. Now that all of the paperwork is in place and your name has been cleared, you can finally bring suit against the police. However, it will be nearly impossible for you to win the case without an experienced personal injury attorney. Law enforcement offices have what is called qualified immunity; this covers them when making an arrest. It is possible to get around qualified immunity, but it takes years of practice and a thorough understanding of the laws of whatever state that you are arrested in. It is unfortunate that a victim of a misunderstanding has to go to these lengths to get justice they obviously deserve.
